(b)"Workweek" and "week" mean any seven consecutive days, starting with the same calendar day each week. "Workweek" is a fixed and regularly recurring period of 168 hours, seven consecutive 24- hour periods.

39 Roberto Alfaro Pinillos, Diccionario práctico de Derecho Procesal Civil, Gaceta Jurídica, Lima, Perú: RESULTANDOS Las Leyes adjetivas prevén en general (por ejemplo, el Código Procesal argentino, art. 163), que la sentencia debe contener “el nombre y apellido de las partes” y “la relación sucinta de las cuestiones que constituyen el objeto del juicio”, es decir, la mención de los hechos alegados por las partes en sus escritos de demanda, contestación, reconvención y contestación de ésta, así como del objeto de la causa de la pretensión o pretensiones deducidas. A esa parte de la sentencia se la conoce con el nombre resultandos. Es costumbre, por otra parte, que entre los resultandos, se incluya un resumen de los trámites sustanciales cumplidos en la causa.

En este aspecto de la decisión, el Juez debe remitirse a los hechos invocados por las partes, confrontarlos con la prueba que se haya producido, apreciar el valor de ésta y aplicar, finalmente, la norma o normas jurídicas mediante las cuales considera que debe resolver la causa.

43 What does this mean for our terminology choices? Resultandos = Case Summary Considerandos = Findings (reasoning) (in fact and in law) Resolutivos = Holding

44 Jurisprudencia Two categories of decisions from the appellate and high courts that can serve as foundation for a court decision: 1)Tesis Aislada (Single Decision) 2)Jurisprudencia (Case law) In generally, 5 consecutive final decisions from the appellate and high courts, along the same line of reasoning, are needed to elevate a legal precedent to the level of case law.

45 Terminology: “en la especie” “En la especie.” (“in the case at hand.”) Often, after analyzing a case-law decision, the phrase “en la especie” is used to refer back to the “case at hand.” To avoid ambiguity, it is not recommended to use the translation “in this case.”

46 Terminology: “toda vez que” + the indicative “Toda vez que” (“insofar as” “inasmuch as,” “given that,” “since,” “because”) El Juez, al haber sancionado a mi cliente con el pago de una indemnización por daños punitivos infringió las normas del debido proceso, toda vez que este tipo de daños no están previstos en la Ley de nuestro país. The Judge, upon ordering my client to pay punitive damages, violated due process, insofar as punitive damages are not contemplated in the law of our country.

47 Doctrina (when referring to the Writings of Legal Scholars) Doctrina is an important element in court decisions in all civil law countries. It can involve very complex topics. The term “doctrina” in this context can be translated as “jurisprudence,” “legal literature,” among other choices. Note that the word “doctrina” in a different sense can also refer to a “principle” or “doctrine,” as in “la doctrina de actos propios” (the principle of standing by one’s own acts) Watch the context! Doctrina is usually written in a textbook form. The structure of the document thus depends almost entirely on the writer.
