2 LABOR COURTS -Article 123 of the Political Constitution of the United Mexican States.- Section 20. The differences or conflicts between capital and labor will be subdued to the decision of a Conciliation and Arbitration Board, composed of the same number of representatives of workers and employers and one of the government. -Federal Labor Law.- Articles 523, 604 to 624 -Federal Conciliation and Arbitration Board.- Responsible for labor disputes arisen in the industry branches mentioned in Article 527 of the Federal Labor Law, such as textile, electrical, mining, petrochemical, etc. -Local Conciliation and Arbitration Boards.- They operate in every state of the federation, to solve labor conflicts that are not within the responsibility of the Federal CAB, Arts. 529 and 621 of the Federal Labor Law.
3 PRINCIPLE OF STABILITY AT WORK Stability in the workplace is a principle that grants the labor relationship a permanent character Its dissolution depends on: 1. The will of the worker, 2. Exceptionally, the will of the employer, 3. A serious breach of the responsibilities by the worker, and 4. Circumstances that make its continuity impossible. It is the unilateral decision of the employer to terminate the labor relationship, without just cause.
4 LAWS REGULATING UNFAIR DISMISSAL Article 123, Section 22. The employer who fires a worker without just cause, or for having joined an association or union, or for participating in a lawful strike, will be compelled, according to the worker’s choice, to fulfill the employment agreement or to a severance payt equal to three months of wages. Art. 48.- A worker who has been dismissed without just cause will be able to request, before the CAB: Constitutional severance pay (3 months salary) or Resettlement in the job he or she performed.
