Key Talking Points: Federal Motor Carrier Safety Administration Mission / Strategy The primary mission of the FMCSA is to reduce crashes, injuries and fatalities involving large trucks and buses. The FMCSA Safety Regulations Pocketbook is the organization’s “bible” for transportation regulations. Purchasing a pocketbook copy for yourself would be well worth the investment. FMCSA is headquartered in Washington, DC and employs more than 1,000 people in all 50 States and the District of Columbia, all dedicated to improving the safety of commercial motor vehicles (CMV) and saving lives. In carrying out its safety mandate to reduce crashes, injuries, and fatalities involving large trucks and buses, FMCSA: Develops and enforces data-driven regulations that balance motor carrier (truck and bus companies) safety with efficiency; Harnesses safety information systems to focus on higher risk carriers in enforcing the safety regulations; Targets educational messages to carriers, commercial drivers, and the public; and Partners with stakeholders including Federal, State, and local enforcement agencies, the motor carrier industry, safety groups, and organized labor on efforts to reduce bus and truck-related crashes. FCMSA implements Compliance Safety Accountability (CSA) in December 2010 The FMCSA began as a separate administration within the U.S. Department of Transportation on January 1, 2000, pursuant to the “Motor Carrier Safety Improvement Act of It was previously under the Federal Highway Administration. A comprehensive program, administered by the FMCSA, under authority of the U.S. Department of Transportation, to improve commercial truck and bus safety by reducing crashes, injuries, and fatalities related to commercial motor vehicles. If a driver receives a 3rd serious violation in that same three year period, their CDL will be suspended an additional 120 days. All violations in a personal vehicle, count against CDL. 9 CSA - Data Collection SourcesSlide Time: 2.0m/Elapsed Time: 81.0m Purpose: To familiarize the student with the Compliance Safety Accountability Program data collection sources. Key Talking Points: CSA uses these four methods of data collection. Roadside Inspections are examinations conducted by a Motor Carrier Safety Assistance Program (MCSAP) inspector on individual commercial motor vehicles and drivers to determine if they are in compliance with the Federal Motor Carrier Safety Regulations (FMCSR's) and/or Hazardous Materials Regulations (HMRs). Inspection data are taken from MCMIS. Violations are recorded during inspections and are entered into the Motor Carrier Management Information Service (MCMIS) database. Serious violations result in driver or vehicle out-of-service (OOS) orders. These OOS violations must be corrected before the affected driver or vehicle is allowed to return to service. State-Reported Commercial Vehicle Crash Data are taken from MCMIS and provide information on crashes as reported by state and local police officials. The reporting of these crashes follows National Governors Association (NGA) standards. Motor Carrier Census Data are first collected when a carrier obtains a USDOT number. This information is recorded in MCMIS by FMCSA and is updated during compliance reviews (CRs), during commercial vehicle registration in states participating in Performance and Registration Information Systems Management (PRISM) Program, and upon request by the motor carrier. Census data are used by the CSMS for identification and normalization of safety-related data. 10 Slide Time: 3.0m/Elapsed Time: 84.0mCSA – BASICs (Driver Compliance) Behavior Analysis Safety Improvement Categories Unsafe Driving Hours of Service Driver Fitness Controlled Substances & Alcohol Vehicle Maintenance HAZMAT Crash Indicator Slide Time: 3.0m/Elapsed Time: 84.0m Purpose: To familiarize the student with Behavior Analysis Safety Improvement Categories (BASICs) program initiated under the Compliance Safety Accountability program. Key Talking Points: How does the CSA accomplish it’s mission? It uses BASICs. BASICs – the CSA uses driver behavior to compare companies’ level of safety Most of the BASICs deal with driver characteristics and behavior. FMCSA will address these driver behaviors by intervening with carriers that use unsafe drivers. FMCSA will also use these same BASICs and underlying data sources to determine the safety fitness of individual drivers. FMCSA uses these categories to measure safety performance and create monthly CSA scores. The safety measurement system will score carriers in each BASIC and make a safety fitness determination to indicate (1) whether a carrier should continue to operate. Categories: Unsafe Driving: Dangerous or careless operation of commercial motor vehicles. Fatigued Driving (Hours-of-Service): Operation of CMVs by drivers who are ill, fatigued, or in non-compliance with the hours-of service (HOS) regulations. This BASIC includes violations of regulations pertaining to log books as they relate to HOS requirements and the management of CMV driver fatigue. Driver Fitness: Operation of a commercial motor vehicles by drivers who are unfit to operate them because they lack training, experience, or medical qualification. Controlled Substances and Alcohol: Operation of a commercial motor vehicle while impaired by or in possession of alcohol, illegal drugs, or any other substance that renders the driver incapable of safely operating a motor vehicle. Vehicle Maintenance: Failure of commercial motor vehicle due to improper or inadequate maintenance. Cargo Related: Unsafe handling of hazardous materials on a commercial vehicle. Crash Indicator: Histories or patterns of high crash involvement, including frequency and severity. Miles carrier logs versus number of accidents. The BASICs are often referred to as the “7 Deadly Sins”. Inspections occurring on or after August 23, 2014, motor carriers and drivers can request inclusion of adjudication information for citations associated with violations in MCMIS inspection reports by submitting Requests for Data Review (RDRs) through FMCSA’s DataQs system (https://dataqs.fmcsa.dot.gov) Motor carriers and drivers would have to upload court outcome documentation in order for the States to review the RDRs and record the court outcomes. How are SMS and PSP records adjudicated? FMCSA’s Safety Measurement System (SMS) and Pre-Employment Screening Program (PSP) would, correspondingly, reflect court outcomes. These systems would retain the violation when it resulted in a conviction; remove the violation when found not guilty or the violation was dismissed without payment of fine and/or costs; and indicate the violation when the court outcome shows a conviction of a different charge. When the court outcome shows a conviction of a different charge, the SMS severity weight tied to the violation will be reduced to the lowest possible value (1). Why is this important? Now a direct connection exists between positive court outcomes and the CSA safety scores of a company/driver. These scores can affect insurance rates, legal liability/exposure, and customer contracts. If we can help the driver with a moving violation or a DOT citation, then the driver can initiate a Data Q challenge. Slide Time: 2.0m/Elapsed Time: 347.0m Purpose: To introduce Riggs, Abney, Neal, Turpen, Orbison, & Lewis as the provider attorney for all CDLP memberships. Key Talking Points: The benefit of having only one number to call and one name to remember (Riggs, Abney, Neal, Turpen, Orbison, & Lewis) is huge to the driver. Just call one number when you have an issue. The driver (or member) must make the initial call to Riggs Abney. It is perfectly fine for the associate to assist the member in making the initial call. After the initial contact is made, the associate should remove himself/herself from any further connection between the driver and the attorney. The member must call within three business days of the issued citation. The Providing Attorney will assign an attorney to the issue after the member’s documentation is received. The Providing Attorney will contact the member by phone and with letter documentation with the contact information for the Assigned Attorney. It is the member’s responsibility to contact the Assigned Attorney directly. The member will need to stay in contact with the attorney until the case is completed and fine is paid (if required).
